Opposition leader YS Jganmohan Reddy once again urged the speaker of Andhra Pradesh Assembly to revoke the suspension of YSRC MLA Roja stating the Motion that was passed suspending Roja for a period of one year under Rule 340(2) of the Business Rules was against the provisions of the said Rule and hence illegal and unconstitutional. In the six-page letter, Jagan sought to draw the attention of speaker Kodela to the rule 374 of Lok Sabha which identical to the 340.
“374. (1) The Speaker may, if he deems it necessary, name q member who disregards the authority of the Chair or abuses the rules of the House by persistently and willfully obstructing the business thereof. (2) lf a member is so named by the Speaker, the Speaker shall, on a motion being made forthwith put the question that the member (naming him) be suspended from the service of the House for a period not exceeding the remainder of the session: Provided that the House may , at any time, on a motion being mode, resolve that such suspension be terminated. (3)A member suspended under this rule shall forthwith withdraw from the precincts of the House”
Jagan asked the speaker to see the functional similarity between Rule 374 of Lok Sabha Business Rules and Rule 340 of the AP Legislative Assembly Rules.
He said the even the Assembly rule, under which the motion to suspend Roja was also clear on the duration of suspension. The rule (340 (2), according to Jagan, clearly limited the suspension of a member to the remainder of the session. ” 340 {2) lf a member is so name by the speaker, the speaker shall on a motion being moved, forthwith put the question that the member (naming him) be suspended from the service of the House for a period not exceeding the remainder of the session,” he said.
He urged the speaker to revoke the suspension of his colleague Roja respecting the rules that govern the functioning of the Assembly.
